This is a legal summary of Flying Acres Homeowners Association (FAHA).  FAHA was originally incorporated in 1992 under the name Crest-Aero.  It was renamed later to avoid confusion between the homeowner association’s name and Crest Airpark.

 

Homeowners’ easement rights for use of the airpark were granted by the 1975 Nesland Easement.

In 2001 FAHA filed a complaint against Crest Airpark in order to enforce the terms of the Nesland Easement through 2025. The case ended in partial summary judgment that extended the terms of the Nesland Easement through 2025, and binding arbitration.

In 2006 FAHA filed a complaint against Crest Airpark to establish a prescriptive easement for walking.  This lawsuit ended in a settlement which gives FAHA members in good standing easement rights for walking on the airport proper and added a purchase agreement that is contingent upon FAHA accepting the appraised price. The Purchase commences when Crest Airpark presents it for purchase or in 2025, whichever occurs first.
